1. About these Terms

These Terms of Use ("Terms") govern your access to and use of The Grow Society's websites, mobile applications, online portals, digital tools, resources, services and other digital platforms (collectively, the Platform).

In these Terms, The Grow Society, Grow Society, we, our and us refer to the entity operating The Grow Society and the Platform.

By accessing or using the Platform, creating an account, purchasing a product or service, downloading a resource or otherwise using our digital services, you agree to these Terms.

If you do not agree with these Terms, you should not use the Platform.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.

2. The Grow Society Platform

The Platform may provide access to services including:

  • The Grow Society website;

  • The Grow Society mobile application;

  • School Program Portals;

  • Family Portals;

  • Volunteer Portals;

  • staff and administrator portals;

  • Garden Club management tools;

  • Garden Club Session Tracker;

  • attendance recording;

  • volunteer participation tracking;

  • community event attendance tracking;

  • impact measurement and reporting;

  • organisation-wide impact dashboards;

  • funding and grant reporting tools;

  • feedback forms and surveys;

  • post-event feedback requests;

  • Family Garden Planner;

  • Planting Planner;

  • postcode-based planting calendars;

  • seasonal planting recommendations;

  • planting reminders and notifications;

  • Compost Helper;

  • compost tracking and educational tools;

  • gardening and sustainability challenges;

  • educational activities;

  • digital resources and downloads;

  • Compost 101 and similar guides;

  • school and family resources;

  • certificates and activity sheets;

  • event registrations;

  • volunteer registrations;

  • community programs;

  • school programs;

  • resource libraries;

  • ecommerce functionality;

  • physical products;

  • digital products;

  • instant digital downloads following purchase;

  • links to external stores or websites;

  • notifications and reminders;

  • photo and activity uploads;

  • program reporting;

  • data dashboards; and

  • other features introduced by The Grow Society from time to time.

Some features may be under development, available only to selected users, or not yet publicly available.

3. Accounts and Portals

Certain Platform features require an account.

Different account types may be provided, including:

  • school accounts;

  • school administrator accounts;

  • teacher or staff accounts;

  • family accounts;

  • volunteer accounts;

  • Grow Society staff accounts;

  • program coordinator accounts; and

  • administrator accounts.

Different account types may have different permissions and access levels.

You must provide accurate information when creating or maintaining an account.

You are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account.

You must not share credentials for restricted staff or administrator accounts with unauthorised persons.

You must notify The Grow Society if you believe an account has been accessed without authorisation.

4. Staff Access and Permissions

Grow Society staff accounts may use role-based access controls.

Depending on a person's role, staff may be granted access to functions including:

  • funding reports;

  • grant information;

  • Garden Club session records;

  • school program information;

  • community event attendance;

  • volunteer information;

  • feedback and survey results;

  • impact statistics;

  • financial or operational reports;

  • program data; and

  • administrative controls.

Users must only access information reasonably required to perform their authorised role.

Unauthorised access, downloading, sharing, alteration or use of information is prohibited.

5. Schools and Organisations

Schools and other participating organisations may nominate authorised representatives to access the Platform.

The organisation is responsible for ensuring that its authorised users use the Platform appropriately.

Where a school supplies information about students, families, employees or volunteers, the school must ensure it has an appropriate legal basis, authority or consent to provide that information to The Grow Society.

The Grow Society may enter into additional agreements, data-sharing arrangements or program agreements with participating schools or organisations.

Where such an agreement conflicts with these Terms, the specific written agreement may apply to the extent of that inconsistency.

6. Children and Young People

The Grow Society provides educational programs and resources that may involve children and young people.

We aim to design and operate our services with children's safety, privacy and best interests in mind.

Where appropriate, child-facing digital features may require involvement, authorisation or consent from a parent, guardian, school or other responsible adult.

Children should not independently provide information that is unnecessary for participation, including home addresses, personal contact information or other sensitive information.

Certain account features may be restricted to adults, schools, parents, guardians, teachers, staff or authorised volunteers.

The Grow Society may introduce additional age assurance, parental consent, school consent or child privacy controls where required.

7. Garden Club and Program Tracking

Authorised users may record information about Grow Society programs, including:

  • session dates;

  • attendance;

  • participant numbers;

  • activities completed;

  • plants planted;

  • produce harvested;

  • garden beds established or restored;

  • composting activities;

  • waste diverted from landfill;

  • volunteer participation;

  • program outcomes;

  • photographs;

  • feedback; and

  • other impact measurements.

Users must only submit information they are authorised to collect and provide.

Where possible, organisation-wide public impact statistics may be presented in aggregated or de-identified form.

8. Photos and Media

Certain Platform features may allow authorised users to upload photographs or other media.

You must not upload photographs or videos of another person unless you have appropriate permission or another lawful basis to do so.

Additional requirements may apply to images of children.

Schools and program coordinators must comply with applicable school permissions, media consent requirements and Grow Society policies before uploading identifiable images of children.

The Grow Society may restrict, remove or disable access to uploaded media where appropriate.

Uploading content to internal program records does not automatically grant The Grow Society permission to use identifiable images publicly for marketing or promotional purposes.

Separate permission may be required for public promotional use.

9. Planting Planner

The Platform may generate planting recommendations based on information including:

  • postcode;

  • geographic region;

  • climate;

  • season;

  • month;

  • selected plants; and

  • other gardening information.

These recommendations are general guidance only.

Local microclimates, weather, soil conditions, pests, water restrictions and environmental conditions may affect planting results.

The Grow Society does not guarantee germination, plant growth, crop yield or gardening outcomes.

10. Compost Helper

The Compost Helper and related resources provide general educational information about composting.

Recommendations may vary depending on compost system, climate, materials and local conditions.

Users remain responsible for safely operating compost systems and determining whether particular materials are suitable.

11. Family Garden Planner

The Family Garden Planner provides general planning and educational information.

Recommendations are not professional horticultural, environmental, nutritional, medical or health advice.

Users should consider their own circumstances and obtain professional advice where appropriate.

12. Notifications and Reminders

Users may choose to receive notifications including:

  • planting reminders;

  • seasonal gardening reminders;

  • program reminders;

  • Garden Club notifications;

  • event information;

  • volunteer communications;

  • challenge updates; and

  • other Platform notifications.

Notification delivery may depend on device settings, internet connectivity and third-party services.

We do not guarantee that notifications will always be delivered or delivered at a particular time.

Users remain responsible for managing important dates and obligations.

13. Impact Tracking

The Platform may combine data from multiple Grow Society programs to calculate organisation-wide impact measures.

These may include:

  • children engaged;

  • families engaged;

  • schools participating;

  • volunteers involved;

  • volunteer hours;

  • Garden Club sessions delivered;

  • plants grown;

  • produce harvested;

  • kilograms of material composted;

  • waste diverted;

  • garden beds established or revitalised;

  • community events delivered;

  • community participants;

  • participating businesses and organisations; and

  • other social or environmental outcomes.

Impact figures may include estimates where direct measurement is impractical.

Where estimates are used, The Grow Society may apply reasonable methodologies to calculate those figures.

14. Feedback and Surveys

The Platform may send or provide feedback forms following programs, events or other activities.

Participation in feedback surveys is generally voluntary unless otherwise stated.

Survey responses may be used to:

  • improve programs;

  • evaluate outcomes;

  • measure impact;

  • prepare reports;

  • support grant and funding applications;

  • communicate outcomes to partners and funders; and

  • improve Grow Society services.

Where practical, public or external reporting will use aggregated or de-identified information.

15. Funding and Grant Reporting

Authorised staff may use Platform data to prepare funding, grant, sponsorship and impact reports.

Reports may include aggregated information collected through Grow Society programs.

The Grow Society may use legitimate program and impact information to demonstrate outcomes to:

  • funding bodies;

  • grant providers;

  • sponsors;

  • partner organisations;

  • schools;

  • government bodies;

  • charitable organisations; and

  • other relevant stakeholders.

Personal information will not be included unnecessarily.

16. Digital Resources

The Platform may provide free and paid digital resources including guides, worksheets, activity sheets, certificates, lesson materials and other educational resources.

Unless expressly stated otherwise, these materials remain the intellectual property of The Grow Society.

Purchasing or downloading a resource gives you a limited licence to use it for its intended personal, family, classroom, school or organisational purpose.

You must not:

  • resell Grow Society digital resources;

  • upload paid resources to public websites;

  • distribute paid resources commercially;

  • claim the materials as your own;

  • remove Grow Society branding or copyright notices for redistribution; or

  • reproduce resources for commercial sale without permission.

17. Online Store

The Platform may allow users to purchase:

  • physical products;

  • educational resources;

  • digital downloads;

  • program materials;

  • gardening products;

  • kits;

  • merchandise; and

  • other Grow Society products.

Prices will be displayed before purchase.

Payment may be processed through third-party payment providers.

Additional shipping, delivery, refund or product-specific terms may apply.

18. Digital Products

Digital products may become available for download immediately or shortly after successful payment.

Because Australian Consumer Law may provide rights and remedies in particular circumstances, nothing in these Terms removes any rights you have under applicable consumer legislation.

19. Third-Party Services

The Platform may integrate with or link to third-party services including:

  • payment processors;

  • ecommerce platforms;

  • mapping or location services;

  • notification services;

  • analytics providers;

  • email providers;

  • cloud hosting services;

  • app stores;

  • social media services; and

  • other technology providers.

Third-party services may have their own terms and privacy policies.

The Grow Society is not responsible for the operation of independent third-party services except to the extent required by law.

20. Acceptable Use

You must not use the Platform to:

  • break any law;

  • harass or threaten another person;

  • upload unlawful, harmful or inappropriate material;

  • compromise the privacy or safety of children;

  • attempt to access accounts without permission;

  • interfere with Platform security;

  • introduce malware or malicious code;

  • scrape or systematically extract Platform data without permission;

  • impersonate another person;

  • falsify attendance or impact records;

  • manipulate program statistics;

  • submit fraudulent information;

  • infringe intellectual property rights; or

  • use Grow Society systems for an unauthorised commercial purpose.

21. User-Submitted Content

Where you submit content to the Platform, you retain ownership of any intellectual property rights you already hold in that content.

You give The Grow Society a limited licence to store, process, reproduce and use that content where reasonably necessary to operate the Platform, administer programs, provide services, maintain records and produce permitted reporting.

This does not automatically give The Grow Society permission to use identifiable photographs of participants or children for public marketing.

22. Intellectual Property

Unless otherwise indicated, the Platform and its content are owned by or licensed to The Grow Society.

This includes:

  • The Grow Society name;

  • logos;

  • branding;

  • illustrations;

  • educational materials;

  • program materials;

  • worksheets;

  • digital resources;

  • software;

  • databases;

  • designs;

  • text;

  • graphics;

  • photographs owned by Grow Society;

  • reports; and

  • original Platform content.

You may not reproduce or commercially exploit this material without permission except where permitted by law or expressly authorised.

23. Availability and Changes

We may update, improve, replace, discontinue or introduce Platform features.

Some features described in these Terms may not yet be publicly available.

We do not guarantee uninterrupted or error-free operation of the Platform.

We may temporarily restrict access for maintenance, security or technical reasons.

24. Suspension and Termination

We may suspend or terminate access where reasonably necessary, including where:

  • these Terms are materially breached;

  • Platform security is threatened;

  • another person's privacy or safety is threatened;

  • an account is used fraudulently;

  • continued access presents a child-safety risk; or

  • access is no longer authorised by a participating school or organisation.

25. Disclaimer

Grow Society gardening, sustainability, composting, food education and planting resources are provided primarily for educational purposes.

Information should not be treated as medical, nutritional, legal, financial or professional horticultural advice.

Nothing on the Platform guarantees a particular gardening, environmental, educational, funding or program outcome.

26. Liability

To the maximum extent permitted by law, The Grow Society is not liable for indirect or consequential loss resulting from use of the Platform.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including rights and remedies that cannot be excluded under the Australian Consumer Law.

27. Privacy

Your use of the Platform is also governed by our Privacy Policy.

Where the Platform handles information relating to children, additional privacy protections and procedures may apply.

28. Changes to these Terms

We may update these Terms where reasonably necessary to reflect:

  • new Platform features;

  • legal requirements;

  • changes to Grow Society programs;

  • security requirements; or

  • changes to our business or organisational structure.

Where changes materially affect users' rights or obligations, we will take reasonable steps to provide notice.

29. Governing Law

These Terms are governed by the laws of Western Australia, Australia, and applicable Commonwealth laws.
